Polite behavior to the survivors is not just expected but socially mandatory. And that's as far as any self-censorship should go. If the comment is in bad taste, others will surely make comments. That's expected. Say what you mean and mean what you say. If it's true, then say it clearly without malice. Let facts say what you want them to say without personal invective.

Stated differently, you do not have the right to not be offended.

Racial hatred is "not nice" but an opinion is not an aggressive act.

    Legalize the first amendment.

No, the entire premise is worthy of mockery.

No. Hitler's death was worth celebrating. That may be the 'extreme example', but it sets the precedent. Celebrating someone's death is generally in poor taste (to say the least), but its still just speech.

When someone on the RW, or a Conservative, or a Republican dies, are YOU willing to not mock them? Because I'm kiiiiiinda thinking that once the tables are turned and the very rules you want enforced on others get enforced on yourself, people seem to change their tune pretty quickly.

There is no such thing as hate speech. It's nothing more than a talking point meant to try and censor/stop/shame people from speaking views others don't like. It's an ideology that is antithetical to what free speech is about.

If he campaigned from his basement he could switch to being a democrat and no one would notice he doesn't know where he is.

Correct. There is no right to not be hated. There is no right to not be offended. There is no right to be surrounded only by what one wants to hear.

I suppose the topic of what constitutes "flamebaiting" would be appropriate to mention here. Too much here, or too little?
