A federal criminal investigation is threatening the proposed merger between former President Donald Trump’s social media enterprise and a special purpose acquisition company, a deal that would give the combined company access to billions of dollars in public markets.

That company, Digital World Acquisition Corp., revealed in a securities filing Monday that it became aware on June 16 that each member of its board of directors received subpoenas from a federal grand jury in New York.

The grand jury wants similar documents that the Securities and Exchange Commission had been seeking in its already-disclosed civil probe, DWAC said. The company received a subpoena itself Friday with similar requests, along with other requests relating to communications, individuals and information involving Rocket One Capital.

    Imagine my surprise.

7 Trump Allies Subpoenaed in Georgia Criminal Investigation

Seven advisers and allies of Donald J. Trump, including Rudolph W. Giuliani and Senator Lindsey Graham, were subpoenaed on Tuesday in the ongoing criminal investigation in Georgia of election interference by Mr. Trump and his associates. The move was the latest sign that the investigation has entangled a number of prominent members of Mr. Trump’s orbit, and may cloud the future for the former president himself.

The subpoenas underscore the breadth of the investigation being conducted by Fani T. Willis, the district attorney of Fulton County, which encompasses most of Atlanta. She is weighing a range of charges, according to legal filings, including racketeering and conspiracy, and her inquiry has encompassed witnesses from beyond the state’s borders. The latest round of subpoenas was reported earlier by The Atlanta Journal-Constitution.

    https://www.nytimes.com/2022/07/05/us/giuliani-subpoena-trump-election-georgia.html

The pace of these investigations given how long ago the potential crimes occurred is an indictment of our system of justice.

California federal judge throws out Trump-era changes that weakened Endangered Species Act

A California federal judge on Tuesday threw out Trump-era changes to the landmark Endangered Species Act, voiding regulations that made it harder to protect wildlife from the effects of human development and climate change.

The ruling by U.S. District Judge Jon S. Tigar restores protections for hundreds of species and comes in response to a lawsuit that EarthJustice, the Sierra Club, the Natural Resources Defense Council and other environmental groups filed in 2019 against the Trump administration.

Changes under Trump had made it easier to remove protections for threatened animals and plants, and allowed federal agencies to conduct economic assessments when deciding whether to protect a species from matters like construction projects in critical habitats. It also removed tools that scientists used to forecast future damage to species from climate change.

Throwing out Trump-era changes is progress.

Feds say 2 NY residents used Trump fundraiser, photo in $27M investment scam

Two New York residents were charged in a federal criminal complaint with a $27 million investment fraud scheme that leveraged their attendance at a 2017 fundraiser with then-President Donald Trump, prosecutors said Monday.

Jody Hice Subpoenaed In Fulton County DA Probe Into Trump’s Election Steal Plot

A new court filing reveals that Fulton County district attorney Fani Willis subpoenaed Rep. Jody Hice (R-GA) last month to appear before a special grand jury in the Fulton County investigation into former President Trump’s efforts to overturn the 2020 election results in the battleground state.

Attached to the new filing is Hice’s subpoena, which instructs him to appear before the grand jury on this coming Tuesday morning. Hice’s request, filed on Monday morning in Fulton County Superior Court, says the GOP congressman seeks to move the proceedings from state court to federal court because he is a member of Congress.

The grand jury’s probe led by Willis focuses on the former president’s efforts to subvert the election results in Georgia, particularly Trump’s infamous phone call to Georgia secretary of state Brad Raffensperger in which he urged the Georgia official to “find” enough votes to overturn Joe Biden’s victory in the state.

New Findings Detail Trump Plan to Use Census for Partisan Gain

A new stash of documents obtained by Congress has confirmed that the Trump administration pushed to add a citizenship question to the census to help Republicans win elections, not to protect people’s voting rights, a House committee report concluded on Wednesday.

The report from the Committee on Oversight and Reform, the culmination of a yearslong investigation, detailed new findings based on drafts of internal memos and secret email communications between political appointees at the Commerce Department, which oversees the Census Bureau, and counterparts in the Justice Department.

The documents provided the most definitive evidence yet that the Trump administration aimed to exclude noncitizens from the count to influence congressional apportionment that would benefit the Republican Party, the report concluded, and that senior officials used a false pretext to build a legal case for asking all residents of the United States whether they were American citizens.

    There really wasn't any doubt.

Giuliani Ordered To Appear Before Grand Jury After Not Showing Up To Challenge Subpoena

Rudy Giuliani was ordered on Wednesday to testify before a Fulton County special grand jury next month in its investigation into former President Trump’s efforts to overturn the election results in Georgia.

The order was made after the former New York City mayor didn’t show up to a hearing in his hometown to challenge the subpoena.

A Wednesday court filing indicated Giuliani did not appear before New York Supreme Court Justice Thomas Farber last week to make his case against the Georgia subpoena, which deemed him as a “necessary and material witness” in the grand jury’s investigation.

Farber has now ordered Giuliani to testify before the grand jury beginning on Aug. 9 “and on any such other dates as this Court may order.”

Wisconsin Judge Slams GOP Review Of 2020 Election

A Wisconsin judge ripped into the partisan “investigation” of Wisconsin’s 2020 election Thursday, saying not only had it not uncovered any evidence of voter fraud, but also that the process had “punished” the people of Wisconsin.

In her last hearing as a judge before retiring, Dane County Circuit Judge Valerie Bailey-Rihn awarded $98,000 in attorneys fees to the liberal watchdog group American Oversight, which has filed several lawsuits against the election investigators for alleged public records law violations.

Bailey-Rihn said she was not awarding any further punitive damages — which like the lawyers fees would be paid by taxpayers — because “I think the people of the state of Wisconsin have been punished enough for this case.” The Associated Press reported the judge’s remarks.

“I don’t think it does anyone any good to have punitive damages placed on the innocent people of this state,” the judge added. The probe has already crossed the seven-figure mark.

    From Crony To Crony
The Washington Post obtained audio of Rep. Matt Gaetz (R-FL) on a hot mic reassuring indicted Roger Stone at a Trump event in October 2019 that “the boss,” in Gaetz’s not-at-all mafioso terms, would pardon him if Stone were convicted of lying to Congress and witness tampering.

    • Gaetz also blabbed about the redacted portions of special counsel Robert Mueller’s report, which he had access to as a member of the House Judiciary Committee. The committee had agreed not to share the redacted material with outsiders, an agreement that had been formalized with the Justice Department, according to the Post.
    • During the conversation, Gaetz said he was cautious about saying too much because “there are many, many recording devices around right now” (people speaking at the Trump event were being filmed). He was recorded by a mic Stone was wearing for a Danish documentary crew.

Still waiting for Gaetz to be indicted.

Trump Lawyers Quietly Prepping For Potential Criminal Charges
The ex-president’s attorneys are biting their nails over the possibility of the Justice Department slapping criminal charges on their client over his efforts to steal the 2020 election, and have started to craft legal strategies accordingly, Rolling Stone reports.

    • Some of the potential strategies reportedly include:
      • Finding a “fall guy” to pin the blame on (more specifically, arguing that Trump had gotten shoddy legal advice from lawyers who got him into this mess)
      • Arguing that Trump was just exercising his right to petition the government under First Amendment with his fake elector plot
    • Former Meadows aide Cassidy Hutchinson’s testimony in front of the House Jan. 6 Committee reportedly ramped up the Trump legal team’s preparation efforts.

Trump Election Attorney To Testify Before Fulton County Grand Jury

The attorney who penned memos arguing that the Trump campaign should create fake slates of electors after losing the 2020 election will appear before a Georgia grand jury later this month. Kenneth Chesebro told TPM that he will appear before the Fulton County grand jury on Aug. 30.

A spokesperson for Fani Willis, the Fulton County District Attorney investigating Trump’s efforts to overturn the election results in Georgia, did not immediately return TPM’s request for comment. The grand jury issued a series of subpoenas last month to Chesebro and others who participated in Trump’s effort to contest the results of the 2020 election.

Sen. Lindsey Graham (R-SC) received a subpoena from the grand jury, as did attorneys who advised Trump, including John Eastman, Rudy Giuliani, Jenna Ellis, and Cleta Mitchell.

Michigan AG calls for special prosecutor in case now involving her Trump-backed opponent

Michigan’s attorney general is requesting a special prosecutor be named to investigate her Trump-endorsed opponent, citing evidence tying him to a potentially criminal scheme to seize and tamper with voting machines, according to documents obtained by POLITICO.

The decision comes after a monthslong investigation by Michigan State Police and the attorney general, Dana Nessel, into voting machine breaches that took place in several Michigan counties. That investigation unexpectedly led to Kalamazoo lawyer Matthew DePerno, whom former President Donald Trump has taken an outsize interest in promoting to be Michigan’s next attorney general.

Trump says FBI raiding his Mar-a-Lago home

The FBI is raiding Mar-a-Lago, former President Donald Trump’s resort home in Palm Beach, Florida, Trump said Monday evening.

In a lengthy statement, Trump said his residence is “currently under siege, raided, and occupied by a large group of FBI agents.”

Some records taken by Trump are so sensitive they may not be described in public

Some of the presidential records recovered from former president Donald Trump’s residence at Mar-a-Lago are so sensitive they may not be able to be described in forthcoming inventory reports in an unclassified way, two people familiar with the matter said Friday.

The revelation comes as Rep. Carolyn B. Maloney (D-N.Y.) sent the National Archives and Records Administration a request for further information on 15 boxes of records recovered from Trump’s Mar-a-Lago resort last month. The Archives set Friday as its deadline for an inventory of the contents.

The Archives has publicly confirmed earlier reporting by The Washington Post that classified materials were found within the boxes and that torn-up records had been transferred to the Archives but not reconstructed by the Trump White House.

The inventory is expected to provide more information on the volume and scope of classified documents, including details on the level of classification, according to the two people familiar with the matter, who spoke on the condition of anonymity to discuss a sensitive topic. There are records at the very highest levels of classification, including some that can be viewed by only a small number of government officials, the two people said.

One news anchor I was watching had the telling reaction of wondering which criminal probe the FBI was there to find evidence for.

If Trump could be trusted to hand over the documents in question by the DoJ issuing a subpoena for their production it would have done so. But, OBVIOUSLY, Trump can't be trusted. Especially given his track record of destroying documents.

Trump tax returns must be given to Congress, federal appeals court says in new ruling

Former President Donald Trump’s federal income tax returns and those of Trump business entities must be turned over to the House Ways and Means Committee, a federal appeals court panel said in a ruling Tuesday.

The 3-0 decision is the latest legal blow to Trump, who has repeatedly lost efforts in federal and state courts to shield his closely guarded tax returns and business-related documents from various investigations. Trump has argued that all of those probes are politically motivated.

Trump will be questioned as New York’s civil investigation nears an end.

Donald J. Trump will face questioning under oath from the New York attorney general’s office on Wednesday, a crucial turning point in a long-running civil investigation into his business practices.

The stakes for Mr. Trump are uncommonly high. While he has sat for numerous depositions over the years, he fought for months to avoid the testimony this week, which could shape the outcome of the investigation into the former president and his family real estate business, the Trump Organization.

    https://www.nytimes.com/live/2022/08/10/nyregion/trump-testimony-investigation-news

Trump.........under oath. That makes him being a pathological liar all the more tricky.

What Does 'Plead the Fifth' Mean? Will Donald Trump Do It?

The ex-president's lawyer has indicated that he will advise Trump to stay mum and invoke the Fifth Amendment's protection against self-incrimination. It's a constitutional right that gets high-profile exposure in settings from Congress to TV crime shows, but there are nuances. Here's what it means — and doesn't — to “plead (or ‘take’) the Fifth."

Trump Refuses To Answer NY AG’s Questions, Invokes 5th Amendment

Ex-President Donald Trump announced on Wednesday morning that he pleaded the Fifth Amendment during his scheduled deposition with New York Attorney General Letitia James (D) in her civil probe into the Trump Organization earlier that day.

In a lengthy screed sent via email and posted on his TRUTH Social app, Trump railed against James’ investigation, which the ex-president claimed was “a vindictive and self-serving fishing expedition.”

“I once asked, ‘If you’re innocent, why are you taking the Fifth Amendment?’ Now I know the answer to that question,” Trump wrote. “When your family, your company, and all the people in your orbit have become the targets of an unfounded politically motivated Witch Hunt supported by lawyers, prosecutors and the Fake News Media, you have no choice.”
