    Let me see if I have this straight. Now that their status may be legal, they are still illegals and do not get the EIC. Is that correct?

    I am well aware that not all illegals are Hispanic......but the vast majority of illegals are Hispanic......and the vast majority of folks committing this type of tax fraud are Hispanic........although blacks do it a good bit as well. It's kinda like the argument that not all terrorists are Muslim.......well, yeah,

    EITC fraud

    Technically, only taxpayers with valid Social Security numbers who are authorized to work in the U.S. are eligible for the tax credit. But identity theft, stolen Social Security numbers, and other scams effectively nullify the restriction. As a result, illegal aliens actually receive the EITC at even greater rates than legal immigrants.

    Three years ago we reported that households headed by illegal immigrants from Mexico were three times more likely to receive the EITC than households headed by native-born Americans.5 We noted that the IRS does little to verify the validity of SSNs on tax returns, or the existence of immigrant children, or to ascertain that they’ve lived with the taxpayer for more than 6 months as required by law. Illegal alien husbands and wives often file separate returns in which BOTH claim the same children.

    In February 2011 the Treasury Department, in effect, acknowledged that the charges we made against the IRS were valid. An audit of IRS procedures by the Department’s inspector general stated the following:

    The Government Accountability Office has listed the Earned Income Tax Credit (EITC) Program as having the second highest dollar amount of improper payments of all Federal programs. The Internal Revenue Service (IRS) has made little improvement in reducing EITC improper payments since 2002 when it was first required to report estimates of these payments to Congress. The IRS continues to report that 23 percent to 28 percent of EITC payments are issued improperly each year. In Fiscal Year (FY) 2009, this equated to $11 billion to $13 billion in EITC improper payments.6


    In the static analysis favored by the Obama Administration, the credit may indeed appear to “raise” thousands of African Americans out of poverty. But this conclusion focuses solely on the cash received by EITC recipients. It ignores the deleterious impact of EITC on minority wages, family size, and debt. It also turns a blind eye to evidence that EITC encourages illegal immigration, a side effect which in the long run hurts minorities more than EITC money helps them.:blankstare:

    Your claim.

    Have you a link to support the assertion, as racially derogatory that it is, that somehow blacks are committing this specific tax fraud?

    Please post it, as your above citation does not support your racially derogatory comments.

    The lefties are so hard set on "zero tolerance" policies in some places...like, suspending a child from school because he "chewed his poptart into the shape of a gun", and all that sort of asinine BS...then so should they be zero tolerance on illegals, but noooooooo.

    (*)(*)(*)(*) that. Round their asses up and send them back.

    The work required would create a lot of jobs for AMERICAN CITIZENS.

    I think you touched on an important point.

    How does one "round up" 11 million asses, determine their immigration status, and send them back?

    I would love to hear whether she still opposes driver's licenses for illegals or if that issue has gone down the memory hole?

    I'm sure that's part of her "evolving understanding" of the issues for 2016. Undoubtedly while she's been out of sight for all these weeks she is being drilled (coached, actually) to find out what she believes in and what she knows.

    Their status is not legal, they are still illegal, their status can not be changed from illegal to legal by policy change in the administration. A required child's SS number is mandatory in order to qualify for the tax credit, to include the child must be present within the US, I gave you the link to the EIC forms, do you not understand how to fill them out or what is required? You still haven't answered what you think makes them legal residents. :yawn:

    Does not I-9 audits do just that? If IRS has all the tax documents, couldn't the Feds just as easily go after the illegal and the fraud they perpetuate? I mean, the illegal at that point is voluntarily giving up his/her location, etc. :roll:

    We could ask for their ID, Passport, DL, SS card, Birth Certificate, etc, if they can not produce any of those, then they could be sent to a higher level for scrutiny. Its not all that hard. Implement E-verify, that will take care of about 99.8% of them. Deny them the ability to rent a house, turn on utilities, etc, they would eventually leave.

    Does an ITIN qualify for earned income credit? Thanks for the info. It wasn't something I was aware of.

    The ITIN allows a person to file tax forms, to qualify for the EIC they must have a child with a SS number living with them in the US, otherwise they do not qualify for the EIC.

    Supposedly.........but not in reality.......I have seen 1000 Hispanic tax returns claiming nieces and nephews living in Mexico and Latin America using ITINs........don't believe me........ask any CPA

    I don't think you fully understand the EITC. Yes, it is a regfundable credit where a person can get more of a refund than what they paid in. However, the EITC is also the singular, most effective item to get people out of poverty for htose all too essential poverty statitics. Without the EITC, more people would be in the poverty threshold than what has been reported. This would also mean that the GOP economic plan would be highlighted into a income gap plan and thus not very popular amongst the working and middle class.

    Think about that for a moment.

    If any person listed on the tax return as an ITIN, then the tappayer cannot qualify for the EITC.

    The ITIN is used for ta purposes only. It does not authorize a person to work in the U.S. Aliens who are required to file a tax return and not eligible for a SSN, may qualify for an ITIN so that they can file their return. See Publication 1915 or the instructions to Form W--7 for additional information. You obtain the publication or the instructions on the IRS.gov web site.

    All persons claimed on the tax return must have a valid SSN in order to qualify for EITC. It is not just the child, but the primary and secondary, if filing jointly, as well.

    SSA has been issuing SSN to non citizens since the 1950's, or longer. The question is whether the non citizen is authorized to work or not. Prior to 1997, when the ITIN became first available, non citizens may obtain a SSN that was not authorized for work prupsoes from the SSA if they met certain requiurements. It turned out that the SS card could be easily copies and the phrase, not authorized, would be left out. Then in 1997, the law changed and the IRS began issuing ITINs for those who were not eligible for a SSN but needed a valid TIN to file a return.

    Althought the ITIN may be used for any alien who is not here legally, it has a more broad purpose than that. There are various reason for whic ha person can obtain an ITIN and they range being a spouse of a U.S. person oo being a dependent ot an alien who is a partner in a partnership, banking purposes, and so forth. Generally, you must file the ITIN application when you file your tax return unless you meet one of the five broad exceptions. Or they may be six.


    the problem is that the use of the ITIN has a much borader debate. For instance, a U.S. soldier, a private for instance, has children and a non citizen spouse, is stationed abroad. Let's say Korea, Germany or Japan. The children and the soldier has valid SSN. If they file jointly, the spouse will need an ITIN snce she is not eligible for a SSN. Assuming the income qualifies and there are no other disqualifications for the EITC other than the ITIN, the U.S. soldier would not be eligible for EITC. When the soldier returns home with the non citizen spouse and obtain a valid SSN, then the U.S. soldier may file an amended return to claim the EITC assuming he is within the statue of limitations for claiming a refund.

    Th rule in question has much broader implications than illegals which some posters, including the OP, are being disingenuous.

    BYW, earning from the U.S. government are considered U.S. source income and serving abroad on a military installation is considered U.S. terirotry for tax purposes for government employees.

    I would agree with that as long as they collected NO Government benefits they aren't entitled to. If they did then the money needs to be diverted to paying that back.
