So theft should be punished by the death penalty ? Well it would reduce the number of people in jail, also a large part of the USA population.

They call that honor killings nowadays, perhaps you should become muslim?

Some seem to find that not of this time anymore.

Not really little periods in western history actuall had such a thing.

And in all it WASNT shooting or killing him while he was defensless on the ground bleeding.

What survival are you claiming the wounded attacker could still have killed the pharmacist ?

Sure anyone you dont agree with doesnt live in the "real world" well in the real world there is such a thing as "the law" .

This case is pretty cut and dry. You can't execute someone after you've subdued them. Even cops can't do that. What this pharmacist did was like putting a suspect in handcuffs and then shooting him multiple times. If the pharmacist had enough time to chase down the other kid, run back into the store and get another gun, he had enough time to stop everything and call the police.

The pharmacist got what he deserved.

The pharmacist was wrong but the sentence is too severe. The governor should step in and reduce the sentence considerably.

He'll probably die in prison before he gets parole.

The robber got the death penalty for trying to steal cigarettes, I think its fair for the pharmacist to get life for murder.

I still disagree. Without knowing the criminal past of the victim or the
amount of crime this pharmacist had to suffer on a reoccurring basis I think the sentence is too severe considering why it happened.

is there a criminal past that would justify leaving and coming back, finding him on the floor in the same spot bleeding, and shooting him some more?

    maybe if hes a vampire....

All of that is irrelevant, especially considering that the perp was unarmed and a minor.

If you're a grown man getting beat up everyday by teenagers, that doesn't give you a right to come back with a tire iron and beat your perpetrators to death.

Really? How many times have you been shot at? (bs to follow I'm sure)

In any case Murder One is pre-meditated. Planned. Calculated. Done with what is determined to be a rational mind. Now me, not being the BSer that I'm sure some people will use to counter this point, I might be in a daze for SEVERAL minutes. I was almost shot a couple times when I lived in Detroit and I never did the Jack Bauer Instant Hero Thing. I was paranoid as shid for an HOUR. The Pharmacist had just pointed a gun at a criminal. First thought in my mind if I'm him "They'll come back for revenge." That's going to dominate my thoughts for some time until I can calm down.

The problem with Libs is they always seem to sympathize with criminals and justify their actions but take a white business owner who was attack by some little scumbag while he was protecting his store?? Their hearts bleed for the poor criminal Max sentence!

    I would've let him off.

Why do you need a criminal record to be sentenced to life for executing someone?

Wait. Are your referring to the criminal that had just burst into their place of business with guns drawn and pointed at them?

Yeah, ya know I always get paranoid when someone comes in pointing a gun at me! I dunno why! Just happens! Gun pointed at me = paranoia! Go figure.

Now I wonder if he would have shot the guy if he DIDN'T break in with the gun drawn? Hmmm. Could that have been a contributing factor? Nah....

It's been pointed out someone who must operate in a high crime area must have been concerned with reprisals and a never ending string of criminal assaults.
All I'm saying is, considering the frame of mind of this pharmacist, life is too high a sentence. I would hope the governor would step in and show leniency.

Which is why he isn't being punished for putting a bullet in the robber's head. He's being punished for putting 5 bullets in the robber's stomach after he was on the ground and subdued.

So he's being punished for being thorough and conscientious and finishing what he started instead of letting the courts and prison system screw up the good work he started?

Look I can respect your feeling that he should have been convicted. I disagree but I understand your reasoning. On the other side, I wonder if you are familiar with the law in this regard. At worst, I would have convicted him of Man 2. We give a different sentence to someone for planning, calculating and seeking out someone they want to murder, than we do someone who has reacted to an event. This is appropriate.
Manslaughter is basically based on mens rea. There are two basic tests for this:

    1. Did he create the deadly situation?
    2. Was he provoked?

I can't see how someone else bursting into his store with a weapon, doesn't immediately meet both of those tests. But then, some people get so closed minded when they want to win an argument, they can never acknowledge even the obvious.

Go ahead. Tell youself he created that situation. Tell yourself he wasn't provoked. Nah, this hasn't become about winning an argument. You're objective. Riiiight.

If I'm to be accused of being a liberal, I'll make excuses like a liberal. Agreeing with you is not my fault. Even a broken clock is correct twice a day. You post so much conflicting garbaaahge you can always claim to be right, OR LEFT, about anything.

No. I am consistent. You cannot cite anything where I have contradicted my myself - that is a lie. Which is not surprising, given the source.
You just don't like that I am not just another brain-washed bubblehead who has a Party / Ideology do all my thinking for me.
So I am consistent about issues but able to keep an open mind. I am also able to admit when I am wrong or don't know about something because I'm not so weak, I worry that my precious party or ideology loses ground if someone else is right.
As opposed to the unthinking lemmings....

It is you who are inconsistent and self-contradicting. THis is easy to prove. When faced with driect questioning about this, you will dodge, change the subject, use moral justification or cut & run. But the fact is, people who have others think for them are indeed, self-contradicting. They're just in such a trance, they don't even know it.
