    That is silly. If someone uses poor judgement and pulls out a fake gun it is not "poor judgement" on behalf of the cop for shooting the guy.

    Well the criminal statutes are on the books, and the definitions are sitting in tort law already and having 'poor judgement' is not the standard in either criminal or civil law. What really ticks me off is that they aren't even getting fired for their poor judgment.

    Never bothered to announce his presence. Prowled around the outside of her house shining a flashlight in the windows. Yelled out a command without giving time for the command to be followed. Shot his weapon into a dark house without having nearly enough information to proceed.
    A woman was shot dead in her home by an officer of the law while she was lawfully defending her home by exercising her second amendment rights. How many things could he have done differently that would have resulted in her being alive today?
    He deserve to have the book thrown at him. Same as any other citizen whose mistakes cost lives.

    Maybe because people expect police to show proportional force to the threat they’re neutralizing?

    Sure, and police have less than lethal means to prevent that from happening.

    258 people were shot by police after a Taser failed to subdue them.
    106 incidents escalated after the Taser didn’t subdue the person.

    Tasers have become an essential tool for police, but how effective are they? An APM Reports investigation finds that officers in some big cities rated Tasers as unreliable up to 40 percent of the time, and in three large departments, newer models were less effective than older ones. In 258 cases over three years, a Taser failed to subdue someone who was then shot and killed by police.

    LOS ANGELES » As two Los Angeles police officers wrestled with a vandalism suspect, one grabbed her Taser and pressed the stun gun against the 38-year-old man’s body.

    The device was supposed to deliver a jolt strong enough to stun him so the officers could take him into custody. But the Taser had no effect, police said.

    Instead, the LAPD said, the man snatched the stun gun from the officer and shocked her in the leg, leaving her unable to move. Her partner then opened fire, fatally shooting the man, Neil Peter White, in the back of the neck.

    you mean the same as a person that made the same mistake in judgement in a similar situation? or should they be above the law?

    like the Church or any group of people, most are good, but a small fraction are bad, same with cops

    the bigger the group, the larger the nimber of bad

    what is wrong is for the leaders of that group to cover up the bad, shove it under the rug

    Your comparing apples to oranges, the average person is not required to place themselves in a situation, where they may be required to use deadly force, therefore they cannot be judged in the same manner.

    The leaders do not have the ability to do that, it appears you understand very little about the process of investigating a LEO shooting.

    Many localities are having a very hard time finding cops willing to work there because of their policies..

    Applications for LEO's are down 67% nationwide, no one wants the job anymore.
