What you fail to report is that same sex marriage is illegalin 31 states. You just can't bypass state law. You can't usurp states' rights.

 

You should certainly know by now that every time a lawsuit is initiated against a state by a same-sex couple and it goes to Federal Court the state ban on SSM is quickly shot down by the court(s). You have to remember that the Federal courts have great power and jurisdiction over the states and can rule against them at any time and the states must comply with that ruling unless overturned by a higher court. Therefore, it may be 31 states, if you're right on that, but that can only mean that same-sex couples in those states need to get busy and challenge those unfair laws so that they can get quickly shot down by the courts and people can enjoy their well-deserved happiness and freedom in marriage as should be and as their Heterosexual counterparts now have.

Certainly! But this matter has nothing to do with S&G unless you are living in a monastery where church law is the ruling party as in a Theocracy.

People have forever used Sodom and Gomorrah as their basis to discriminate against Gay Americans but they are wrong in using that Scripture as it does not speak to homosexuality at all despite their beliefs. It speaks to something quite different and the use of inappropriate Scripture like that has caused many Gays and Lesbians to become seriously hurt by bigots and those who continue to discriminate against LGBT individuals and it has even caused their deaths. But I suspect you do not care about that and perhaps even relish the thought that it has. How pitiful to know that such a person exists who would feel that way, with your blurb of S&G.

These are the ONLY cases which federal courts have constitutional authority to hear! Alexander Hamilton wrote in Federalist No. 83, 8th para:


…the judicial authority of the federal judicatures is declared by the Constitution to comprehend certain cases particularly specified. The expression of those cases marks the precise limits beyond which the federal courts cannot extend their jurisdiction, because the objects of their cognizance being enumerated, the specification would be nugatory if it did not exclude all ideas of more extensive authority.

 

All that a plaintiff would need to do is allege that the rule is unconstitutional discrimination in violation of the 14th amendment and the courts would have jurisdiction.

It's not really surprising to see that the thread got into definitions of perversion, descriptions of 'natural' behaviour and religious references. Everybody has some stuff they won't budge on and homophobes are no different to that. In my opinion, gay rights will be equalised in the same context that gender rights are. There will still be inequality but we're moving the right direction. The increased noise from its detractors is to make up from the ground that they are losing. Society is shifting, for better or worse, it is shifting. As it usually does.
As to the article, essentially I'm reading that being anti-gay is a stronger motivator than being pro-veteran for a section of the USA's legislature. That is very sad but I'm guessing the platform that these poli's run on is dependent on them taking this stance? More's the pity. I hope it works out.
