Constitution specifically makes exceptions for incarcerated individuals. however, even prisoners do maintain some Constitutional rights.
AFAIK, no court has ruled on whether it is Constitutional to ban Illegal Immigrants and folks here on a Travel/Work/Education/Diplomatic Visa from exercizing their 2nd Amendment Rights. But if the purpose of the 2nd Amendment is to recognize the natural right of all human beings to defend themselves & their families, all persons in the USA should have gun rights.

Based on the permit application I see no reason to believe legal Resident Aliens can't get a gun permit in NYC.
I'm trying to remember where it says in "Shall not be infringed" it says anyting about a) naturalization status or b) non-criminal status. If a person is in a prison or jail cell, then they should be restricted from possession of firearms, among other things. I don't see where else they can be rightfully infringed. Maybe you can find the hidden text in the language.
