No, what I mean is that people with criminal records aren't going to go through the legal process, since they will probably get caught during the vetting process.

Thus, it is far more likely that those who are murderers, rapists, gang members and drug dealers, i.e the scum of society, are going to be illegal aliens.

Which of course, is exactly what Trump meant when he said "they aren't sending us their best".

I don't think that is an accurate statement of fact.
    They fight to get here.
    Nobody sent them here.
I have seen it for myself.

Federal law says you retain most rights until you are convicted of a FELONY.

crossing the border illegally is not a felony.

just as not coming to a full stop at a Stop Sign, makes you a criminal.

do you think citizens should lose their 2nd Amendment rights for failing to come to a full stop at a Stop Sign?

why do you ask such questions when your posts demonstrate that you really don't support the second amendment as it was intended to be interpreted. The second amendment was a not written to allow SOME infringement. But your posts clearly support massive amounts of infringement

I think the rest of us are aware by now that you haven't got a clue as to what "federal law says".

And the RKBA is not among them because...?

There are plenty of misdemeanors you can be jailed for. Try committing one, insisting on your RKBA throughout your sentence, and let us know how that works out for ya.

I'd like them to try to pass that background check without getting themselves deported.

In the context of the preamble "people" refers to citizens. The 14th says "people within the jurisdiction of the USA" obviously meaning all people. The 1st does not state that religion or speech is a right of the people but instead says that the government shall make no law that prohibits it so no matter who it targets it is unconstitutional simply because they are not allowed to make such laws. It also says that the 'people' have the right to petition their government. 'people' like the 2nd amendment refers to citizens.

Then, technically, if you have ever driven recklessly, you are a criminal.

Would it not be easier, then, to allow everyone in except those who are convicted, violent criminals? The tight regulations on immigration are an effective prohibition on most immigration and that creates a virtual black market for those who come in without processing.

So you want to allow anyone who wants to enter the US to live here to do so legally.

    smh.
