Marine faces 15 years behind bars for unknowingly violating gun law

    Did you know it was commonly understood in 1939 and earlier that the 2nd Amendment was a guarantee that US citizen had a right to the same weapons as the military to is ensured the militias has the same weaponry as the military in case of invasion and it also allowed the citizens to fight back in case of a tyrannical government?

    In 1939, Judge Ragon authored an opinion in United States v. Miller, 26 F. Supp. 1002, stating that a federal statute violated the Second Amendment. His opinion was reversed by the United States Supreme Court in United States v. Miller because nobody showed up for the defense and the government won the case basically by default because the government lied and said sawed off shotgun were not in use in the military which they were.

    So in a sense, we should be able to have and carry any and all types of weapons used in our military arsenal.

    Why would any reasonable person think that your state issued concealed permit would be legal in another state?

    Who doesn't check the gun laws when traveling to a different state? That's idiotic.


    I highly doubt that he will get anything more than a slap on the wrist. Its obvious he meant no harm, and is a marine. Maybe next time he'll do a little research before traveling with a weapon.

    Absolutely, felons should have that right, as its given by the Constitution, and before you start whining, you already the fix, its called a Constitutional Amendment. Activist judges have no place in limiting our rights when there is a perfectly legal and proper method which we the people can decide, not unelected political appointees that only have to get Senate approval.

    I was asked a moronic question about the 2nd amendment that I answered.

    obviously there are limitations that are not written directly into the amendment.

    such as a concealed carry permit

    Because most concealed carry permits from one state are honored by other states as well. A Tennessee permit, for instance, is valid in 39 states in the Union. A person with a TN permit could drive from Florida to Washington state with a concealed weapon and never run afoul of the law. Oddly enough a TN permit is not valid in NY but a NY permit is valid in TN.

    If you know how to read, you don't need me to tell you anything, just pick up a copy of the Constitution. The 2nd Amendment is all of 26 words, and if you can't figure it out, you really have no place trying to limit others of the very rights you don't seem to understand.

    Ignorance of the law is no excuse. He is a licensed to carry a firearm in another state; common sense would dictate that he know the gun laws of other states before bringing in a weapon into another state.

    No worry, he'll have plenty of time to study up on the gun laws in prision.

    No offense but this is not the wild west here, if you don't like the gun laws of New York City, then don't visit.

    I'm not one for expanding the federal government but a federal gun reciprocity law I would agree on to force states to recognize licensees of other states like marriage and driver licenses.
